Jackson County Medical Pot Advocates Resort to Ballot Initiative
The owners of MaryJane’s Basement in Medford, Richard and Marlene Nuckols, are gearing up to ask voters to overturn that city’s ban on medical marijuana dispensaries.
In May, Judge Timothy Gerking upheld the city’s decision to revoke the business license of MaryJane’s Attic and Basement, finding the Oregon Medical Marijuana Act is in conflict with federal law. Gerking also said substantial evidence also showed MaryJane’s was not operating lawfully under Oregon’s marijuana act.
The Nuckols plan to apply for a new business license with Medford this month. The Nuckols had a separate business, MaryJane’s Attic, which sold clothes, jewelry and other items.
The Oregon Health Authority has issued 7 marijuana dispensary licenses in Jackson County but only Gold Hill and Talent have operating outlets. Four others license holders are not operating.
